Research in Motion, which makes the popular Blackberry messaging devices, said it is very close to a software upgrade that circumvents patents owned by NTP. RIM in recent months appears to be heading toward a loss in NTP's patent infringement lawsuit against them, and RIM will still be liable for damages or at least an out-of-court settlement. But by switching to a different software technology, RIM can avoid everyone's fear of a forced shutdown via a court injunction. They'll also avoid having to license NTP software in the future.
