NSA off the hook for wiretapping suit

The National Security Agency should not have to deal with a lawsuit that challenges the propriety of secretly tapping into communications without court-ordered warrants. At least, that is the position of a divided Sixth Circuit Court of Appeals, which ruled late last week on a lawsuit brought by the American Civil Liberties Union and a group of journalists, lawyers and academics. The reason? The plaintiffs could not show that anyone was actually harmed by the NSA's practices, according to a ComputerWorld report. The latest ruling reverses a lower court ruling on the same issue. The U.S. Department of Justice says that the NSA program has been "a vital intelligence program that helped detect and prevent terrorist attacks."
