CIOs, lawyers need to start speaking the same language

Miscommunication between CIOs and lawyers is no laughing matter. The stakes are high for the CIO and the company, both monetarily and professionally. To make sure you're on the same page, treat e-discovery like disaster recovery. That means thinking broadly about all existing data stores, from spreadsheet documents to email, instant messaging, USB flash drives, Web server logs and home computers. Any and all can be subpoenaed. Review and document all data stores and note which policies apply to each. Know where the data is kept, how long, how much, how it is backed up, if automatic destruction is involved, who has access and who owns the data. CIOs should know how to stop deletion if the data is put on litigation hold. In essence, treat e-discovery like disaster recovery and do periodic run-throughs to make sure data is accessible. And get used to working with discovery vendors and your outside litigation counsel. This isn't going away any time soon.
